These Terms and Conditions ("Terms") govern your access to and use of the websites ajaini.com and ajaini.in (collectively, the "Website"), operated by Ajaini Living ("Ajaini," "we," "us," or "our"), a sole proprietorship registered in Keralam, India, engaged in the business of selling women's fashion and lifestyle products.
By accessing or using the Website, placing an order, or creating an account, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.
1. Eligibility
By using this Website, you represent that you are at least 18 years of age or are accessing the Website under the supervision of a parent or legal guardian. If you are under 18, you may use the Website only with the involvement and consent of a parent or guardian.
2. Account Registration
2.1 To place an order or access certain features, you may be required to register an account and provide accurate, current, and complete information.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 Ajaini reserves the right to suspend or terminate accounts that provide false, inaccurate, or misleading information, or that are used in violation of these Terms.
3. Products and Product Information
3.1 We make every effort to display our products, including colours, fabric, and details, as accurately as possible. However, actual colours and appearance may vary slightly due to screen settings, lighting, and photography, and such variation shall not constitute a defect.
3.2 All product descriptions, images, sizes, and prices are subject to change without prior notice.
3.3 We reserve the right, at our sole discretion, to limit the quantity of products sold to any person, household, or order, and to discontinue any product at any time.
4. Pricing and Payment
4.1 All prices listed on the Website are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless otherwise stated.
4.2 Ajaini reserves the right to change prices for products displayed on the Website at any time without prior notice, provided that such changes will not affect orders that have already been confirmed.
4.3 Payments may be made through the payment methods made available on the Website, including but not limited to credit/debit cards, UPI, net banking, and other third-party payment gateways. All payments are processed through secure, PCI-DSS compliant payment gateways, and Ajaini does not store your card or banking details.
4.4 In the event of any payment failure, transaction error, or discrepancy, Ajaini shall not be liable for delays or failures caused by the payment gateway, bank, or Users' financial institution.
4.5 A GST-compliant invoice will be provided for every order placed on the Website.
5. Order Confirmation and Acceptance
5.1 Placing an order on the Website constitutes an offer to purchase the product(s), which Ajaini may accept or reject at its sole discretion.
5.2 An order is deemed confirmed only upon receipt of an order confirmation via email/SMS/WhatsApp or through the Website, and after successful payment realisation.
5.3 Ajaini reserves the right to cancel any order, at any stage, due to reasons including but not limited to: unavailability of stock, inaccuracies in product or pricing information, suspected fraudulent or unauthorised transactions, or errors in the order or product information.
6. Shipping and Delivery
6.1 Ajaini currently ships orders only within India.
6.2 Estimated delivery timelines will be communicated at the time of order confirmation or on the product page; however, such timelines are indicative and not guaranteed. Delays may occur due to logistics, courier constraints, weather conditions, or circumstances beyond our reasonable control.
6.3 Risk of loss and title for products purchased passes to the customer upon delivery to the shipping carrier or upon delivery at the address provided by the customer, as applicable.
6.4 It is the customer's responsibility to provide accurate and complete shipping information. Ajaini shall not be liable for non-delivery or delay in delivery resulting from incorrect or incomplete address details provided by the customer.
7. Returns, Exchange, and Refunds
7.1 Ajaini offers a return window of 7 (seven) days from the date of delivery, subject to the conditions below.
7.2 To be eligible for a return, the product must be unused, unwashed, unaltered, with original tags, labels, and packaging intact, and must not fall under the non-returnable categories specified on the Website (including but not limited to innerwear, sale/clearance items, and customised products, where applicable).
7.3 Refunds, where applicable, will be processed to the original mode of payment within a reasonable period after the returned product has been received and quality-checked by Ajaini. Processing timelines may vary depending on the payment provider or banking partner.
7.4 Ajaini reserves the right to refuse a return or refund if the returned product does not meet the eligibility conditions stated above.
7.5 In the case of damaged, defective, or incorrect products delivered, customers must report the issue within the applicable return window, along with supporting evidence (such as photographs/unboxing video), to enable verification and resolution.
8. Intellectual Property
8.1 All content on the Website, including but not limited to the Ajaini and Ajaini Living names, logos, trademarks, product images, graphics, text, and design, is the property of Ajaini Living or its licensors and is protected under applicable intellectual property laws.
8.2 No content from the Website may be copied, reproduced, republished, distributed, or used for any commercial purpose without the prior written consent of Ajaini.
9. User Conduct
You agree not to:
- Use the Website for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorised access to the Website, its servers, or any connected systems;
- Upload or transmit any harmful code, malware, or disruptive content;
- Engage in any activity that interferes with or disrupts the Website's functioning;
- Misuse promotional offers, discount codes, or engage in fraudulent transactions.
Ajaini reserves the right to take appropriate legal action and/or restrict access to Users found in violation of this clause.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Ajaini shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Website or the purchase of products, including but not limited to loss of profits, data, or goodwill. Ajaini's total liability in relation to any order shall not exceed the amount paid by the customer for that specific order.
11. Indemnity
You agree to indemnify and hold harmless Ajaini Living, its proprietor, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Website.

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, any disputes arising out of or in connection with these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the courts of Keralam, India.
